In cases of maritime casualties, we advise and act in relation to groundings, collisions, pollution incidents, salvage operations, towage disputes and wreck removal in Spanish ports and territorial waters.
We act on behalf of shipowners, hull and machinery insurers, P&I Clubs, tug owners and professional salvors.
We negotiate Lloyd’s Open Form and other standard-form salvage agreements and, where a port of refuge is required, we liaise with the Spanish Directorate-General of the Merchant Marine to secure the necessary administrative authorisations.
We arrange the filing of bails, bank guarantees and other acceptable forms of security and defend administrative and Port State Control proceedings initiated as a consequence of a casualty or pollution incident.
It is specifically noted that Spanish courts and authorities may not accept letters of undertaking issued by P&I Clubs or civil liability insurers.
We provide legal assistance in relation to general average and limitation of liability proceedings.
Following investigations by appointed marine surveyors, we analyse liability and quantum, attempt negotiated settlements and, where necessary, conduct litigation or arbitration proceedings to achieve compensation for physical and financial losses, supported at all times by appropriately appointed marine surveyors.
